Terms and conditions of sale

1. Foreword

1.1 The offer and sale of products on our website https://www.silviagagliardini.com/ (hereinafter the Site) are governed by the following General Terms and Conditions of Sale (hereinafter the Terms) which apply to any person visiting or making a purchase on the Site.

1.2 The Terms may be subject to change, provided that the Terms applicable shall be those in effect at the time the order is placed by the Customer.

1.3 Access to and use of this Site, as well as the purchase of products presuppose the reading, knowledge and acceptance of these Terms and Conditions.

1.4 The products purchased on this Site are sold by Joyful di Silvia Gagliardini - Via Agri 3 - 00198 Roma (RM) (hereinafter the Seller).

1.5 Anyone browsing the Site is solely and exclusively responsible for the use of the Site and its contents. Viewing the Site, purchasing our products, and acquiring information about them is an activity that each user performs for personal use and unrelated to commercial activity.

1.6 Each user is solely responsible if the information and data provided is false, incorrect or related to third parties, who have not given their consent.

1.7 The Seller is not responsible for any damage to the user caused by browsing the Site and the user assumes all risk in this regard.

1.8 You are responsible for the safekeeping and proper use of your personal information, including the credentials that allow you to access restricted services, as well as for any harmful consequence or prejudice that may arise against the Seller or third parties as a result of the incorrect use, loss, theft of such information. 

2. Order

2.1 A purchase order (hereinafter the Order) must be placed using the appropriate form available within the Site.

2.2 The Seller reserves the right not to accept purchase orders: - from countries outside the European Community; - with a delivery address without a contact person, at hotels or post office boxes; - in the event that the user who placed the Order cannot be reached; - in case of doubt as to the validity of the Order.

2.3. After the placing of the Order the Seller shall send the customer an e-mail confirming the Order, Afterwards the Seller, again by e-mail, shall inform the customer about the shipment of the products. 

3. Price

3.1 The prices shown on the site are in euros, including Italian taxes (European VAT and other applicable taxes). Packaging, packing and transportation costs are included in the final price.

3.2. For deliveries within the European Community, no customs duty is charged; outside the European Community, customs charges are the responsibility of the customer.

3.3. The Seller reserves the right to change prices at any time. Products already ordered will be invoiced on the basis of the prices in effect at the time of receipt of the Order. 

4. Warranty and Liability

4.1. Jewelry products are made of bronze, brass, or silver, using stones, enamels, and leathers, as indicated in the relevant sheets. They are handcrafted through an entirely manual process that ensures their authenticity. These metals depending on the skin PH may cause discolorations on the leather. Any imperfections or alterations express the value and uniqueness of each piece. All jewelry made is nickel free.

4.2 All products are covered by the two-year legal warranty of conformity.

4.3 Defective products that the customer returns during the two-year warranty period will be replaced or repaired by the Seller, any form of refund or compensation being expressly excluded.

4.4 The warranty shall be recognized where the following conditions are met: - the customer has notified the Seller via e-mali of the return of the defective products; - the defect is not due to abnormal or non-compliant use, an accident, or an external cause (such as intervention on the product by unauthorized persons); - the defect is not due to wear and tear or normal aging.

4.5 The cost of shipping and return of products shall remain fully borne by the customer.

4.6. The Seller disclaims all liability in the event that the delivered products do not comply with the legislation of the country outside the European Union to which they are possibly delivered.

4.7 The Seller undertakes to provide attention in accordance with this work to ensure the service offered to the customer. However, the Seller is in no way responsible for the failure to meet contractual obligations due to unforeseeable circumstances or force majeure, in accordance with Italian law. In addition, in the event of insubstantial differences between the photographs presenting the products on the Site,the texts, illustrations and the products ordered, the Seller is in no way responsible.

4.8 The Seller shall not be liable under any circumstances for loss of benefits, commercial losses, loss of information, loss of earnings, or any other indirect or unforeseeable damage at the time of using the Site or concluding the sales contract with the customer. 

5. Payment

5.1 For payment of the price of the products, only the PayPal or Shopify Payment method as indicated in the purchase form shall be used. All payments must be made in Euro currency.

5.2 The data provided to make the payment will be used by the Seller only and exclusively to complete the procedures related to the purchase and to issue the relevant refunds in case of any product returns. The purchase price of the products, as indicated in the purchase form, will be charged to the Customer's bank account at the time of purchase of the products. 

6. Reservation of Ownership

Purchased products remain the property of the Seller until delivery to the carrier.

7. Availability and delivery of products

7.1 The purchased products will be delivered to the address indicated in the Order, together with the relevant invoice, within 15 days from the dispatch of the Order confirmation referred to in Article 2.3 above, or in the case of a product available only by order, it will be delivered at the different times specifically indicated in the Order confirmation.

7.2. In case of payment by bank transfer, the delivery date will start from the moment the price is credited.

7.3 The terms indicated in Article 5.2 above are to be considered indicative. In case of delay, the Seller will contact the customer by e-mail or telephone as soon as it has such information.

7.4 If despite acceptance of the Order a product is not available or cannot be delivered, the Seller will promptly inform the customer by e-mail and the Order will be cancelled. In such case, the customer shall only be entitled to a refund of the price paid, any other form of compensation being expressly excluded.

9. Right of withdrawal - Returns and size exchanges

9.1 Purchases concluded on the Site are regulated by Legislative Decree 185 of May 22, 1999. The customer may withdraw from the contract by written notice by registered mail AR to be sent to Via Agri 3 - 00198 Rome (RM) within 14 working days of receipt of the products. We recommend in any case to the customer to contact us at +39 335 585 2747 to facilitate the refund procedure that will take place within 14 days through the same method of payment used by the customer, once we receive the return or size exchange that must be in the same condition in which it was shipped.

9.2 Shipping costs will be paid by the customer for both returns and size exchanges.

9.3 The right of withdrawal - in addition to compliance with the terms and methods described in the previous articles - is considered exercised correctly if the following conditions are also fully respected:

    the products must not have been used or damaged;
    the products must be returned in their original packaging, together with the relevant invoice.

9.4 In the event that the products for which the right of withdrawal has been exercised are damaged or have suffered a decrease in value due to use that has been made of it, the Seller reserves the right to deny the right of withdrawal or to charge a cost to the customer as compensation.

10. Refund times and methods in case of exercise of the right of withdrawal

10.1 After returning the products, the Seller will verify that the products have not been damaged or tampered with. In the event that the checks are concluded positively, the Seller will send the customer, via e-mail, the relevant confirmation of acceptance of the returned products.

10.2 The refund of the price paid will be made by the Seller as quickly as possible and in any case within fourteen (14) days from the date of confirmation of acceptance of the returned products via PayPal or bank transfer.

10.3 If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the sums due for their purchase, the reimbursement of the sums, in the event of exercise of the right of withdrawal, will be carried out towards the person who made the payment.

11. Access to the Site and ownership rights

11.1 The Seller grants access to the Site and its use by the customer exclusively for the customer's personal use.

11.2 The contents of the Site are protected by copyright and all other industrial and intellectual property rights of the Seller and other rights holders. The trademark Flaminia Barosini jewellery designer and logo, as well as the domain www.flaminiabarosini.com are registered.

11.3 The customer is never authorized to download, reproduce, copy, sell, exploit or modify a part or the whole of the Site (in particular the listed products, descriptions, prices, download or copy information, use data, programs, sound content, graphics, images, text, photographs, tools) without an explicit written authorization from the Seller.

11.4  The Site may contain links to other Internet sites. Such sites are not, under any circumstances, under the control of the Seller who is not responsible for the accuracy, respect for intellectual property rights, legality, decency or any other aspect of the content of such sites.

12. Protection of Personal Data

12.1 The Seller is committed to protecting the customer's personal data. All personal data concerning the customer that the Seller has collected shall be treated strictly confidentially, in accordance with applicable privacy laws.

12.2 The customer's personal data collected by the Seller from the products that the customer chooses serve exclusively for the satisfaction of the customer's order under the best possible conditions and serve to propose to the customer offers suitable for him

12.3 The customer's personal information is never rented, assigned or sold to third parties for purposes other than the satisfaction of the customer's order

12.4 The customer has the right to access and change the totality of personal information through the secure interface of personal account management

12.5 The non-personal data collected by the Seller from the users' navigation on the Site serve to improve the service proposed to the customers, in particular the ergonomics of the site, the products presented and the customer relationship. 

13. Applicable law and dispute resolution

The present Conditions are governed by Italian law and any dispute arising in connection with the use of the Site and/or the purchase of the products shall be devolved to the exclusive jurisdiction of the Court of Rome.
